These terms govern orders placed through this website, including personalised (engraved) products. Payment is taken online at checkout through Stripe, operated by Stripe Payments Europe, Limited. Checkout requires you to accept these terms before an order is placed.

01Who you are dealing with

This website is operated by ACE OF WANDS Arturs Spāde, a sole trader registered in Poland in the Central Register and Information on Economic Activity (CEIDG), business address al. Jana Pawła II 43A/37B, 01-001 Warszawa, Poland, REGON 545309155, tax identification number 9512652638 ("PODD", "we", "us"). For questions about these terms, contact contact@podd.gg.

02Scope & acceptance

These terms apply to orders placed on this website, for delivery to the countries listed at checkout: the member states of the European Union together with Switzerland, the United Kingdom, Iceland, Liechtenstein, Norway, Bosnia and Herzegovina, Moldova, Montenegro, North Macedonia, Serbia and Ukraine. They sit alongside our Privacy Policy, which forms part of the same terms.

We may update these terms from time to time. The version in force is the one published on this page at the time you place your order.

03Orders, pricing & payment

Prices are shown and charged in euro (EUR). Checkout shows the product, engraving, delivery and any discount amounts before you pay. An order is placed only after the site accepts it and shows a verified confirmation page.

We take reasonable care to ensure prices and product details are accurate. If a pricing or listing error is discovered before dispatch, we will contact you before proceeding and you may cancel free of charge.

Payment is taken online at checkout through Stripe, operated by Stripe Payments Europe, Limited. Available methods include card, Apple Pay and Google Pay. Payment details are handled by Stripe. The payment operator is Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland, registered in Ireland under number 513174.

04Availability & orders

All current colourways can be ordered. The configurator shows current availability before you continue to checkout.

An order is concluded when you place it at checkout and the payment is completed through Stripe. If PODD cannot fulfil your order, PODD contacts you and you may cancel free of charge.

05Personalisation & moderation

Products offering engraving let you supply custom text and, where enabled, an uploaded image or font selection ("Submitted Content"). By submitting content you confirm you own the rights to it and that it does not infringe any third party's rights.

Right to refuse. We reserve the right to review, reject or request changes to any Submitted Content prior to production, at our sole discretion — including but not limited to content that is offensive, unlawful, infringing, or technically unprintable within the engraving zone. If we reject your content you will be asked to resubmit, or the order will not proceed until the issue is resolved.

Because engraved products are made to your specification, the 14-day withdrawal right does not apply to them once a purchase is concluded. Checkout requires a separate acknowledgement before an engraved order can be placed. This does not limit your rights for faulty or misdescribed goods, which are unaffected.

The model withdrawal form — Annex 2 to the Polish Consumer Rights Act — is sent with your order confirmation and is available at any time on request at contact@podd.gg. The form applies to orders covered by the withdrawal right, that is, products without engraving.

06Delivery

Delivery is by tracked courier to the countries listed at checkout. The delivery cost is shown at checkout before you pay and is included in the total. Risk in the goods passes to you on delivery.

07Returns & withdrawal

If you are a consumer, you have the right to withdraw from your purchase within 14 days of receiving your goods, without giving any reason. This applies to every product ordered without engraving or other personalisation; engraved products are covered by §5 of these terms.

To withdraw, tell us within those 14 days by email to contact@podd.gg or by post to the address below, giving your order number. Any clear statement is enough; you may use the model withdrawal form, but you do not have to. You then have 14 further days to send the goods back.

Return postage is paid by you. If you withdraw, you pay the direct cost of sending the goods back to us.

Items should be returned unused, in their original packaging where possible. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature and function of the goods.

Reimbursement is made using the same payment method you used, includes the standard delivery cost, and is due without undue delay and no later than 14 days after PODD is informed of the withdrawal. PODD may withhold reimbursement until the goods are returned or you provide evidence of sending them back, whichever happens first.

If an item — personalised or not — arrives faulty, damaged or not as described, this is a legal warranty claim, separate from the withdrawal right, and you do not pay to send it back. Write to contact@podd.gg with your order number and what is wrong before sending anything; we will answer every complaint within 14 days of receiving it.

08Warranty & liability

Goods are warranted to be free from material defects for a period required by applicable EU consumer law from the date of delivery. This does not affect your statutory rights.

PODD products also carry a voluntary 25-year warranty, set out in the 25-Year Warranty terms.

To the maximum extent permitted by law, our liability for indirect or consequential loss is excluded. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or fraud.

09Governing law & disputes

These terms are governed by the laws of Poland, without prejudice to any mandatory consumer-protection rights you have in your country of residence.

A consumer may also resolve a dispute out of court. The routes available in Poland are mediation by the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), the permanent consumer arbitration court operating at that inspectorate, and free assistance from the municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów). Bodies authorised to conduct out-of-court consumer dispute resolution are listed in the register kept by the President of UOKiK at polubowne.uokik.gov.pl. These procedures are voluntary and require the agreement of both sides. We do not undertake in advance to take part in them, which does not affect your statutory rights or your right to bring the matter before a court.
